Congratulations to MBL Senior Attorney James Flynn, who recently secured a summary disposition win for an insurance client. James argued that Plaintiff, a DME provider, could not prove it provided any equipment to the claimant. As Plaintiff could not produce critical records related to the at-issue devices/treatment, Plaintiff would be unable to meet their burden of proof at trial. Following extensive briefing and oral argument, the Court was persuaded by the Defendants’ arguments and granted the motion, dismissing nearly $30,000 in billing.
