MBL Senior Attorney Eisha Vatsal Romana secured the dismissal of nearly $50,000 in provider bills after discovery revealed three separate grounds for summary disposition.
First, Eisha successfully argued that services were fraudulently billed under an incorrect CPT code. Second, Eisha convinced the Court that the provider was not entitled to innocent third party status, as it received Explanation of Benefit forms denying coverage and yet failed to investigate further before continuing treatment with the patient. And finally, the Court agreed that additional charges for laser therapy were improperly performed without the supervision of a physician.
This result — borne out of the effective briefing and fact-intensive review of Eisha and her paralegal, Michelle Matwiejczyk — resulted in more than half of the claimed damages being dismissed.
