Congratulations to Co-Managing Partner Marc McDonald, Partner Sulvia Alsaigh, and Associate Daniela Llenga on securing a complete victory on a Motion for Summary Disposition under MCR 2.116(C)(8) and (10), delivering a strong result for an MBL insurance client.
The lawsuit alleged premises liability and negligence due to a slip and fall incident at the parking lot of a well-known restaurant. MBL successfully argued that Defendant, the owner of the premises, did not have possession or control of the premises at the time of the incident. Additionally, MBL argued that Defendant could not be liable under an ordinary negligence theory because Plaintiff’s claim was based on a condition of the land – unnatural accumulation of black ice – not on Defendant’s conduct.
The Court agreed and dismissed the case with prejudice, effectively eliminating Plaintiff’s damages claim against MBL’s client in its entirety.
