If you have a Michigan auto insurance policy with no medical PIP coverage, whether that policy applies after a motorcycle accident depends on which no-medical option you chose.
- Option 6 (Medicare opt-out): Your policy does not apply to a motorcycle accident.
- Option 4: Your policy does apply, and the injured motorcyclist may be entitled to up to $250,000 in medical benefits, along with wage loss and replacement services.
In a recent case involving a motorcyclist and multiple vehicles, the insurance company argued it did not have to pay because the policy had a $250,000 medical limit and certain exclusions. The court disagreed.
The judge explained that while the policy’s dollar limit applied, the exclusion only applies to the named insured and close family members living in the household. Because the injured motorcyclist did not fall into that group, the policy remained responsible for coverage.
Bottom line: Not all “no medical” PIP policies are treated the same. The details of the policy can make a significant difference in whether coverage is available after a motorcycle accident.
