UM/UIM Claims Dismissed Following Key Coverage Determination

MBL Partner Jason Proctor and Principal James Flynn were successful in a highly contested Motion for Summary Disposition on an Uninsured/Underinsured Motorist (UM/UIM) case. Across three separately filed cases spanning several years, Jason and James were able to identify the unknown “John Doe” driver who fled from the scene of the accident.
Though meticulous discovery, they established that “John Doe” was the boyfriend of the vehicle’s owner, who carried an existing insurance policy and therefore did not qualify as the “uninsured” under the terms of the policy. After the parties presented the Court with competing Motions on the issue of available coverage, the Court sided with MBL’s client, dismissing the UM/UIM claims and MBL’s client from the case.
This victory represents another example of MBL’s thorough fact development and the expert application of those facts to the law for its clients.
