Strategic Investigation Leads to Dismissal of $20,000 in Unsupported Pharmacy Bills for MBL Client

MBL successfully obtained dismissal of more than $20,000 in prescription medication bills after challenging whether the Plaintiff could establish compliance with Michigan’s pharmacy licensure requirements under the Michigan No-Fault Act. The issue: whether the pharmacy had a properly licensed pharmacist in charge operating during the dates of service at issue.

Although Plaintiff produced responsive documentation, MBL Associate Amy Schroeder dug deeper, scrutinizing the dates, license numbers, and underlying records. She, along with Executive Partner Kaitlyn Cramer, challenged the evidence as inaccurate and insufficient to create a genuine question of material fact.

The Court agreed. Because compliance with licensure requirements is a prerequisite to compensability under the Michigan No-Fault Act, and Plaintiff failed to present sufficient evidence to support compliance, the Court granted summary disposition in MBL client’s favor.
