In August, MBL Co-Managing Partner Marc McDonald, Partner Brett Windecker, Senior Attorney Alex Grapentin, and Paralegal Paulina Shammami had a successful trial result challenging the reasonableness of submitted medical bills. The billing dispute was the sole issue at trial – and the jury’s verdict made their position clear.

Yesterday, the Court granted the MBL insurer client’s motion for attorney fees under MCL 500.3148, finding that the billing was “so excessive as to have no reasonable foundation.” This supports legal counsel’s argument that cases like this are the basis for No-Fault Reform. Notably, the judge remarked that she rarely awards attorney fees – but in this case, even the jury commented on the excessiveness of the charges.
