Congratulations to MBL Principal Garrett Guibord and Associate Attorney Ardijana Ivezaj on securing a complete dismissal of over $245,000 in provider benefits claims for an MBL insurance client.
Through a Motion for Summary Disposition regarding fraud in the inducement of the policy, the MBL legal team successfully argued that, although the underlying claimant was a resident relative at the inception of the policy, she was not listed as a rated driver and at no point did the named insured attempt to rectify this issue.
Both the Plaintiff and Co-Defendant, who had their own priority MSD, argued that MBL’s client should be in priority for payment as the claimant was an innocent third party. Ultimately the Court ruled in favor of MBL’s client, paving the way for the dismissal of other active suits.
