Congratulations to MBL Partner Jason Proctor, who successfully obtained a summary disposition dismissal of negligence claims brought against an MBL client under Michigan’s Owner Liability Statute.
Relying on a strategic application of statutory elements and case law, Jason demonstrated that liability requires express or implied knowledge or consent from the vehicle’s owner. Through carefully crafted affidavits from involved parties, he showed that the client’s vehicle was taken without her knowledge or permission, while her boyfriend was asleep.
After an extensive oral argument and judicial deliberation, the Court agreed with Jason’s position and dismissed all claims, ruling that his client bore no liability under the statute.
