MBL Prevails on Fact-Intensive McCormick UM/UIM Motion

Congratulations to MBL Senior Attorney Eisha Romana on securing summary disposition in an uninsured/underinsured motorist (UM/UIM) case.
Eisha successfully argued that the plaintiff failed to establish a threshold injury under Michigan law, demonstrating both a lack of objective medical evidence and no meaningful impact on the plaintiff’s ability to lead her normal life. Through a strategic analysis of controlling case law, medical records and the plaintiff’s own testimony, Eisha showed that the plaintiff could not satisfy the requirements set forth in McCormick under Michigan’s No-Fault law.
McCormick motions are highly fact-intensive. Courts can often deny such motions and cite a question of fact as an “easy way out.” Eisha’s thorough review of the record and strategic use of the evidence left no room for that conclusion, effectively eliminating any genuine issue of material fact and positioning the case for dismissal. The Court agreed and dismissed the plaintiff’s claims in their entirety.
