MBL Secures Complete Defense Verdict in $1.3M Cervical Fusion Claim

McDonald Baas & Livingston PLLC (MBL) is pleased to announce a complete defense verdict obtained by attorneys Courtney L. Ware and Frederick L. Livingston following a jury trial in Macomb County Circuit Court. This is the 2nd No-Cause trial win and 3rd favorable trial result in one month for MBL.
In this case, the plaintiff sought approximately $1.3 million in non-economic and excess economic damages, alleging that a low-speed motor vehicle accident caused cervical spine injuries that ultimately required a two-level cervical fusion surgery. Although the plaintiff had no documented history of cervical spine symptoms predating the accident, the jury returned a verdict finding that the accident did not cause the claimed injuries.
Through a disciplined and evidence-driven defense, Courtney and Fred demonstrated that the plaintiff lacked credibility and failed to establish an objectively manifested impairment as required under Michigan law. Their command of the medical record, careful cross-examination, and clear presentation of the causation evidence allowed the jury to see the case for what the proofs showed it to be.
