Two Wins. $300,000 in Potential Exposure Eliminated.
October 20, 2026
MBL Associate Hatem Yahfoufi secured two significant victories for an insurance client in Washtenaw County, eliminating $300,000 in potential exposure.
In the first matter, Hatem obtained summary disposition in a coverage and priority dispute involving PIP and UM/UIM benefits. During an early deposition, he secured critical admissions that the plaintiff was neither related to the named insured nor a resident of her household, establishing that the plaintiff was not entitled to coverage or benefits from the insurer.
On the eve of the hearing, the plaintiff advanced a new equitable reformation theory, seeking to rewrite the policy to provide coverage. Hatem demonstrated that the theory lacked evidentiary support and that the plaintiff’s newly submitted affidavit contradicted his deposition testimony, including admissions that he never intended to be added to the policy or believed he was insured under it.
The Court granted summary disposition, dismissing all claims against the insurer with prejudice.
In a second matter, Hatem also secured the dismissal of a related provider lawsuit. Through careful evaluation of the factual record and successful motion practice, the provider’s claims against the client were dismissed, resulting in another favorable outcome for the insurer.
Congratulations to Hatem for his strategic advocacy in protecting the client’s interests.
