Standing Challenge Leads to Complete Defense Victory for MBL Client

MBL Associate Ardijana Ivezaj recently secured summary disposition in a Michigan No-Fault action involving prescription claims after successfully challenging the plaintiff’s standing to pursue reimbursement.

The plaintiff was not the facility that rendered treatment – rather, they were a billing company attempting to recovery the amount at issue. They sought recovery under an assignment of benefits and, in support, tried to present a pharmaceutical license for the physician working at the treating facility. Ardijana argued that the assignment did not transform the plaintiff into the provider of services and therefore did not confer standing on a non-treating facility. She further demonstrated that no employee of the plaintiff – the party attempting to recover the bills at issue – possessed the proper pharmaceutical licensing required under the Michigan No-Fault Act.

Following extensive oral argument, the Court agreed, finding that the plaintiff lacked standing to bring the claims as it was not direct medical provider with a cause of action under the statute, thereby granting summary disposition in favor of MBL’s client.
