Congratulations to MBL Partner Norma Gant and Associate Gregory Dallas on securing a dismissal of a first-party PIP benefits claim through a successful dispositive motion on standing and capacity—saving our insurance client hundreds of thousands of dollars.
Because a lawsuit cannot be brought in the name of a deceased person (who lacks standing or capacity under the law), the MBL team investigated the matter after failed attempts at discovery and uncovered that the Plaintiff had, in fact, passed away months before the suit was filed.
The Court agreed, granting the motion and dismissing all claims with prejudice.
