Plaintiff sought UM/UIM benefits and more than $287,000 in PIP benefits, including medical expenses, wage loss, and replacement/attendant care. MBL successfully argued that Plaintiff was neither a named insured nor qualified for coverage as a resident relative, removing the client from the order of priority.
The Court agreed and dismissed the case with prejudice, effectively eliminating Plaintiff’s $287,000 damages claim in its entirety.
