Congratulations to MBL Senior Attorney Nancy Gadallah on securing a dismissal of a provider’s first-party PIP benefits claim through a successful Motion for Summary Disposition for a case that was assigned to MBL’s client through the Michigan Assigned Claims Plan (MACP).
In this case, Plaintiff’s counsel argued that a claimant’s non-cooperation should have no impact on a provider’s claim. Nancy, however, persuasively demonstrated — and convinced the Court — that under the MACP, a claimant’s failure to cooperate can indeed bar recovery of all related benefits, including those sought by providers.
The case was dismissed with prejudice in favor of MBL’s first-party client. Excellent work, Nancy!
