Congratulations to MBL Partner Mark Cole and Senior Attorney Maggie Mason on achieving consecutive wins on Motions for Summary Disposition, delivering strong results for an MBL insurance company client.
In the first case, a medical provider sought reimbursement for treatment rendered to the boyfriend of an insured. At the inception of the policy, the insured affirmatively stated she was the only member of her household and the sole named insured. The Court ruled that the claimant did not qualify as a spouse, resident relative, or named insured—and was therefore ineligible for benefits under MCL 500.3114(1).
In the second matter, the insured had opted out of PIP coverage based on having qualified health coverage under MCL 500.3109a(2). A provider later filed suit seeking payment for medical services rendered to the insured. MBL successfully argued that the opt-out was valid and enforceable, and the Court granted summary disposition, finding that no PIP benefits were owed.
