MBL is pleased to announce yet another successful Motion for Summary Disposition that led to the dismissal of a First-Party PIP, Uninsured/Underinsured, and a Provider-PIP case in one swoop.

Associate Hanna Beck-Sawyer wrote and argued the motion with the guidance of Partner Jason Proctor. In a case where the Plaintiff took his sister’s vehicle without permission and drove it while intoxicated and unlicensed, the MBL Team obtained confirming testimony from the vehicle owner that it was taken without permission. The Court agreed that this precluded Plaintiff from benefits under MCL 500.3113(a), granted MBL’s Motion and dismissed the Plaintiff’s PIP claim with prejudice. On the heels of the MSD victory, MBL was able to secure subsequent dismissals of Plaintiff’s Uninsured/Underinsured Motorist claim, as well as the claims of an intervening medical provider.

The work by the MBL Team ultimately dismissed over $100,000 in claims made against its insurance client.
