MBL’s Appeals Team recently defeated a Plaintiff’s Application in a case concerning causation in a personal injury dispute. The Michigan Court of Appeals denied the Plaintiff’s interlocutory appeal, affirming the lower court’s decision to grant Defendant’s motion for summary disposition. The Court found that the Plaintiff’s toe amputations were not causally related to the subject motor vehicle accident.
Senior Attorney Eisha Vatsal and Executive Partner Kaitlyn Cramer successfully argued in the appellate response that the Plaintiff’s amputations resulted from an infection caused by a fracture and open wound sustained after dropping a drill press on his foot. The Plaintiff contended that his injuries were linked to the accident, but the Court agreed with MBL’s position that the alleged connection was too tenuous.
