MBL is pleased to announce back-to-back Motion for Summary Disposition wins in favor of MBL insurance clients, led by Executive Partner Nadine Hammoud.
Both unrelated cases involved fraud in the procurement of an insurance policy.
The first matter involved a PIP/UM claim where an uninsured Plaintiff panicked on the accident scene and applied for coverage after the crash was reported to police. Despite Plaintiff’s arguments that the policy was procured earlier in the day, the Wayne County Circuit Court disagreed, finding no policy was in force at the time of the accident, dismissing the case in its entirety. Plaintiff claimed over $300,000, including interest and attorney fees.
Second, Plaintiff filed suit seeking coverage following an alleged theft. Upon further investigation, it was determined that Plaintiff provided false statements during a lapse in coverage in an attempt to have coverage retroactively. The Court agreed with the Defendant, finding the Plaintiff did not have a policy in force at the time of the alleged theft, dismissing the case. The Court also found that Plaintiff’s claim was fraudulent, misrepresented the facts of loss, and lacked reasonable foundation, awarding Defendant attorney fees under MCL 500.3148.
