MBL congratulates Senior Associate Stephanie Fall and Partner Jill Peterson on a successful Motion for Summary Disposition resulting in dismissal of third-party tort claims against their client under MCL 500.3135. Plaintiff’s counsel argued that he sustained an objectively manifested impairment of important body function affecting his general ability to lead his normal life and was entitled to tort benefits under the statute. However, Stephanie successfully argued that imaging showed no objective injury related to the accident. Plaintiff only sought treatment upon attorney referral and there was no evidence to suggest a change to his ability to work, socialize, or attend school. Ultimately, the Court agreed Plaintiff failed to show any effect on his daily life as it relates to the motor vehicle accident. The case was dismissed without prejudice in favor of their insurance client.
